Memorandum of Understanding between the Ministry of Justice, the National Ombudsman for Childhood and Adolescence, and Bambinisenzasbarre ONLUS

This Italian policy is a great example to the rest of Europe of how the children of prisoners can be formerly recognised at a national governmental level.

The memorandum was agreed upon by the Minister of Justice, the President of Bambinisenzasbarre, and the National Ombudsman for Childhood and Adolescence in March 2014, and sets out measures regarding children of prisoners in Italy. It includes measures which aim to improve the consideration of offenders' children when passing judgements or sentences; the ways in which a child and parent keep in contact during the sentence; and the collection of data on children whose parents are imprisoned. Additionally, it establishes a permanent working Table to assume the task of both monitoring progress and promoting any further work that can be done. Articles of the document focus on children's rights and treatment in the following areas:

  • 1. Decisions concerning judicial orders, judgements and sentences. This article notes that judicial authorities should be sensitised and invited to consider the interests of young children.
  • 2. Minor's visits to prisons. Here the ministry of justice commits to ensuring visits are more child friendly and accessible.
  • 3. More types of relationships with imprisoned parent. This article commits parties to considering flexibility in types and methods of maintaining imprisoned parent/child relationships.
  • 4. Training of the staff. Here it is noted that staff development around prisoners children is necessary.
  • 5. Information, assistance and instruction. This article covers the giving of information to children, families and parents about different stages of the CJS as well as notes the importance of a family focus and support for inmates.
  • 6. Data collection. This article asks that data about prisoners children is collected, collated and made publicly available.
  • 7. Transitional provisions. Here it is noted that children who need to stay within correctional centres are properly supported and have access to services.
